PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from facebook.com/therugtruck/ (the “Site”).


PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

Additionally when you register an account, make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your user name and password, personal name, business name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”.

When you enter an optional contest or sweepstakes, respond to a survey or special offer or post a review, we may collect additional personal information such as your opinion about our products, services, social media pages or our Site (“Additional Information”).

When we talk about “Personal Information” in this Privacy Policy, we are referring collectively to Device Information, Order Information and Additional Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Personal Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use Personal Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud;
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services;

- Improve our Site and social media pages;

- Develop new products and services;

- Conduct surveys; and

- Respond to your interests, needs and preferences.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with affiliates, business partners and third parties to help us use your Personal Information, as described above. We may also share your Personal Information with other companies outside of us, our business partners and affiliates, as follows: (i) as permitted by law, (ii) in the event of a transfer of ownership, assets or a bankruptcy of our business, (iii) where we determine that disclosure of specific information is necessary to investigate security breaches or to comply with the request of a law enforcement or regulatory agency or other legal process, or (iv) to protect our interests or safety or that of our users or visitors to the Site.

BEHAVIORAL ADVERTISING
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. OPT-OUT CHOICE

We may send you electronic communications because you have visited our website and left contract information.  We hope these electronic communications will be useful.  If we send you any electronic communication, that communication will provide to you the ability to tell us that you desire to opt-out of receiving future communications from us.  You may always choose not to provide information, even though it may be needed to access and take advantage of certain aspects of our Site.  If you do not want to receive marketing or other communications from The Rug Truck (other than communications that may be required by law), you may opt-out by e-mailing us at contactus@therugtruck.com, indicating your desire not to receive future communications.  We will endeavor to comply with your request as soon as reasonably possible, and you must understand that we may need to retain certain information for record-keeping purposes.  Please also note that we are not responsible for informing third party business partners and service providers with whom we have already shared your Personal Information and/or account information of any changes requested pursuant to this section, or for removing information from or causing information to be removed from the databases or records of such entities.  Persons who have registered for an account have access to review, update, correct and/or remove their personal information through the login to your account portion of the Site which is accessible only by using their user name and password.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

DATA PROTECTION

The security of your data is important to us.  The data collected on the Site is maintained in databases that are housed on equipment stored in secure, limited access facilities.  Access to the database is restricted to those employees that are responsible for collecting the data and those whose duties require them to use the data.  This Site employs reasonable security measures to help protect the Personal Information submitted to us from loss, misuse, alteration or unauthorized access, both during transmission and once we receive it. Even with such measures, no website, method of transmission over the Internet or method of electronic storage is one hundred percent secure, so we cannot ensure or warrant the security of any information you provide.

DATA RETENTION
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

COPYRIGHT COMPLAINTS AND COPYRIGHT AGENT

 

    • Termination of Access for Repeat Infringers.  We respect the intellectual property rights of others and request that our users do the same.  Pursuant to 17 U.S.C. 512(i) of the United States Copyright Act, we have adopted and implemented a policy that provides for the termination in appropriate circumstances of users of this Facebook page who are infringers.  We may terminate access for participants or users who are found to provide or post protected third party content without necessary rights and permissions.

 

    • DMCA Take-Down Notices.  If you are a copyright owner or an agent thereof and believe, in good faith, that any materials provided on or through this Facebook page infringe upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (see17 U.S.C 512) (“DMCA”) by sending the following information in writing to our designated copyright agent:

 

  1. The date of your notification;

 

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

 

  1. A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online website are covered by a single notification, a representative list of such works at that site;

 

  1. A description of the material that is claimed to be infringing or to be the subject of infringing activity and information sufficient to enable us to locate such work;

 

  1. Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and/or email address;

 

  1. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

 

  1. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    • Counter-Notices. If you believe that your user content that has been removed from the Facebook page is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use such content, you may send a counter-notice containing the following information to our copyright agent using the contact information set forth above:

 

  1. Your physical or electronic signature;

 

  1. A description of the content that has been removed and the location at which the content appeared before it was removed;

 

  • A statement that you have a good faith belief that the content was removed as a result of mistake or a misidentification of the content; and

 

  1. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal courts in New Jersey and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

 

If a counter-notice is received by our copyright agent, we may send a copy of the counter-notice to the original complaining party informing such person that we may reinstate the removed material in 10 business days.  Unless our copyright agent receives notice from the complaining party of the complaining party filing or intending to file an action seeking a court order against us or the alleged infringer to restrain from engaging in infringing activity relating to the material at issue, we may replace the material in not less than 10, nor more than 14 business days from receipt of the counter-notice.
